Notices Of Public Sales In Newspapers Are Obsolete.

In Texas, our storage lien notification laws are dated and do not utilize current technology. The current law is 30 years old and needs to be modernized. Placing an advertisement in a newspaper's legal section is no longer the best way to notify the public, nor a delinquent tenant, of an upcoming storage sale.

If Chapter 59 of the Texas Property Code was amended to allow self storage facilities to publicize their auction via a public website, Texas newspapers would lose millions of dollars in annual revenue. However, collectively, storage facilities would save millions of dollars on their advertising costs. Think about it, why would a storage company pay a newspaper hundreds of dollars every month, per facility, to publish a public notice, when they could advertise their auction on a storage auction related website or their own website for next to nothing?

When companies like Public Storage, U-Haul Storage Centers, Private Mini Storage, Uncle Bob's Self Storage & other storage facility chains realize that they could be saving tens, if not hundreds of thousand of dollars a year by publishing their notices online, they will abandon ship. Every storage facility will benefit from this change, regardless of their size. Legal notices in newspapers will be a thing of the past.

Bottom line, we should consider which method of notification best represents the interest of the delinquent tenant. Allowing legal notices to be placed on a public website would give a delinquent tenant a better chance of finding the information they are searching for.

The current law worked fine 30 years ago when it was written. It worked better for smaller to medium size towns that only had one newspaper, everyone knew where to look. Nowadays, if a tenant were seeking information on the sale of their property, it would be like searching for a needle in a haystack.

So, how would a change to Chapter 59 affect the storage auction buyer?

If every storage facility in our area listed public notices on a different website, this would make an already imperfect system all the more confusing. Can you imagine having to visit hundreds of websites to find storage auction information in your area?  With no centralized information source, the entire system is flawed & confusing. We all need to get on the same page, literally.

In January 2011, a month after the storage auction shows premiered, new buyers were attending storage auctions in record numbers and it became difficult to purchase a storage unit at a reasonable price. I remember thinking about the other professional storage auction buyers that I saw every week. These are people who have built their life around these auctions and depend on them to make ends meet. They are the people who were truly suffering from the aftermath of the storage reality shows. These people are just like you and I, they have mortgages, car payments, bills and other expenses. I think most storage auction buyers will admit that it has become more difficult to make ends meet and that the storage auction business has changed, permanently.

Once I realized that the influx of new buyers attending self storage auctions wasn't just a trend, I knew that I had to get off the beaten path if I wanted to survive in the storage auction business. I did some research and I found out that over half of the facilities in my area advertised their storage auctions in a smaller, local newspaper. The problem was, there were so many smaller cites and towns within our city, most of which have their own newspaper, that subscribing to and reading them all every day wasn't an option. I was determined to figure something out and I did.

I learned that the storage unit auctions that aren't advertised to the masses generally have fewer buyers that attend the event. Where there is less competition, there is a better chance of buying a quality storage unit at a good price. I was determined to find these storage auctions.

What started off as a way for me to survive in the storage auction business, quickly turned into a way I could help other storage auction buyers. I built a database, started calling the storage facilities and began publishing the auction list. It took a lot of time and effort to continually deliver a quality product, but it was worth it. The storage auction schedule became so popular with storage auction buyers, that I decided to expand into other cities. Now, AuctionsTX.com is the #1 resource for storage auction buyers in Houston, Dallas, Fort Worth, San Antonio and Austin, Texas.

Pros and Cons of Buying Storage Units at Auctions

There are several pros and cons in buying storage units at auctions. It really depends on what your goals are. If your goal is to acquire a lot of nice things for yourself for pennies on the dollar, then you should give it a try. If your goal is to make some extra money buying then reselling merchandise, it can be a great business to be in. If your goal is to get rich quick, chances are it is not going to happen.

So, obviously, the pros are you can acquire a lot of great stuff for yourself at a low price and you can resell merchandise and make a profit. Another pro is that you will meet a lot interesting people & possibly make new friends. Last but not least, if you choose to make this a business, you choose the days and hours you want to work; no more punching the time clock!

The Cons: It's a lot of work. I used to spend about 40-50 hours per week attending self storage auctions. You have to inspect a lot of units before one comes across that has the merchandise you want and at the same time sells at price that you can make money on it.

Once you buy a storage unit, you have to excavate it. This can actually be a lot of fun if you bought the right unit, but if you have been digging through boxes for an hour and you still don't see the return on your investment, this could definitely be a con.

Now you have to move everything. Some buyers only buy storage units that they can fit into their car. Others have pickups, trailers & moving trucks, so size isn't really an issue for them.


Make sure that you have someone lined up to help you move the contents of the storage unit. Most storage units contain furniture or appliances that can be difficult to move. Some units aren't packed well or contain lots of trash, this can be time consuming trying to organize the contents of this type of unit.

You have to deal with people. This can be a pro or con, depending on your personality. You will have to deal with people in person when you are selling your merchandise. You will receive lots of phone calls, lots of tire kickers and people who don't show up for their appointment, but, I guess that is the same in every business.


Ever since the new storage auction shows premiered, there has been a migration of new buyers attending storage auctions in Texas and throughout the United States. Because of this, prices for storage units have risen at some storage auctions. That's why is is so important to get off the beaten path and attend the auctions that typically have fewer people in attendance. There are still days; however, that there are multiple storage auctions taking place at the same time. These are good days to go out because the crowds are thinned and you have a better chance of getting a good deal.

In my opinion, the greatest reward from being a storage auction buyer is that you can acquire some incredible things for yourself for free, after you sell the other items in the storage unit. All in all, if you are willing to work at it, and pay your dues learning this business, it can be quite rewarding.

 

Are The Storage Auction Reality Shows Staged?

Although entertaining, the storage auctions reality shows do not depict storage auctions accurately. Auction Hunters is a little far-fetched, showing some incredible finds in almost every episode. Not that you couldn't find items similar to what they have found, it just doesn't happen quite that often. I believe that the producers recognized the things being said about the program and decided to respond to the comments directly through the content in the first episode of the second season, in which, they were very direct when informing the audience that most storage units contain common items. Storage Hunters is a joke, with all of it's fights and expletives. Storage Wars is a little more believable, although the drama lately is getting a little thick. Keep in mind that these shows must be entertaining otherwise they wouldn't be on the air for long. They are showing their best finds, and who knows how many storage units they had to purchase before they found one worthy to be put on television. If you are new to the storage auction scene, take these shows with a grain of salt.

Why Do People Store Their Property At Self Storage Facilities?

Some people just need extra space around their home, although you have to consider that a lot of people who store their property at self storage facilities are in transition. Some people run small businesses out of their storage unit, this is a lot cheaper than renting a commercial warehouse or store front. Others, just have things that they cannot or do not want to store at their homes or businesses.

 

What Is The State Requirement For Sales Tax?

What is the state requirement for sales tax, is it required or not? I have heard different stories.

Emily, as far as the sales tax is concerned, you have a few different options. Let me start out by saying that I'm not an accountant or an attorney and you should consult with a professional if you have specific question regarding this issue. 

If you don’t already have one, you can apply for a sales tax use permit on the Comptroller’s website. With a sales tax use permit, you don't pay sales tax when you purchase a storage unit, but you are responsible for collecting sales tax on everything you sell. If you don't have a sales tax use permit, you will need to obtain one or pay sales tax on any storage units that you buy. Even if you pay sales tax up front, you must still collect or pay sales tax on everything you sell.

If you are asking whether you have to pay sales tax or not, the answer is yes. Sure, this is an all cash business, and some people do try to cheat, but why take that chance? Records are being kept by the storage facilities and the auctioneers of every storage unit purchased. This information could be used against you if you ever got audited by the state.

Do The Storage Facility Employees Go Through The Units?

Hi, I'm trying to understand how all of this works. Since you guys seem to know what some of the lockers have inside, does this mean the storage facilities have already gone through the lockers and they could have taken out items they wish to keep for themselves?

Storage facilities in the state of Texas are required to provide a brief description of the contents of the storage unit in the legal notice that they have published. Some storage facilities choose to ignore this as they do some of the other requirements in Chapter 59 of the Texas Property Code, but we won’t get into that at this time.

Once the storage facility has made several attempts to contact the tenant for payment, with no success, they will cut the lock and usually inventory the contents of the storage unit based on what they can see from the door. Very rarely do they ever move things or open boxes.

Should you be worried about this? Not really. Most storage facility managers & owners are very honest and respectable people. I’m sure there are a few bad apples, as there is in any business, that do enter the unit and remove the valuables before the auction. However, if you are only bidding on what you can see from the door, what may have been removed from the unit will not effect you.

How Do I Know Which Auctions Were Advertised In Smaller Local Newspapers?

Most large cities have multiple smaller cities and towns within them and most of them have their own local newspaper. Subscribing to and reading them all every day isn't an option. Don't worry though, we have you covered. At AuctionsTX.com, we provide a comprehensive list of every storage auction occurring within Houston, Dallas, Fort Worth, San Antonio, Austin and their surrounding areas.

Over half of the storage facilities in these areas don't advertise in the large, mainstream newspapers due to the cost or because they are located in a suburban or rural area and aren't in the newspaper's coverage area. These other storage facilities typically place their public notices in  smaller newspapers located within their immediate area. Public notices placed in these local newspapers typically get less exposure, resulting in fewer bidders attending the event. These are the auctions you want to go to because when there is less competition, chances are you will be able to buy a unit at a better price.

Where Can I Find Storage Unit Auctions in Houston, Texas?

If you are a sucker for punishment, you can get storage auction information through several other sources.

There are handful of companies which provide storage auction listings on a national level; However, they fail to list over 85% of the auctions in our area. These companies are a waste of money.

There is a local business newspaper which lists about half of the auctions occurring in our area; However, the information they provide is incomplete and often contains mistakes. This business newspaper only lists the auctions of the storage facilities that pay them to publish their legal notices. Although they claim to publish notices for 99% of all storage facilities in the greater Houston and surrounding areas, over 700 storage facilities do not advertise with this publication. This is where AuctionsTX.com picks up the slack. It supplies every storage auction that this business newspaper furnishes in addition to the auctions from the other 700 + facilities.

There are also a handful of auctioneers in our area that provide storage auction information on their websites. If you have a lot of spare time, you can call the storage facilities and most will be happy to provide information on their storage sale. Even if the cost weren't an issue, it would require you to spend hours every day researching & organizing all of the legal notices.

If you are new to the storage auction scene, allow me to give you some advice that will save you a great deal of time and money. If you are an experienced storage auction buyer, you already know what I'm about to tell you. The auctions listed in the business newspaper mentioned above are swarmed with new buyers due to the popularity of the storage auction reality shows on television. Most of these highly publicized storage auctions have 50-100 or more people in attendance and it has become more difficult to buy a storage unit at a reasonable price. If you want to make money in this business you have to get off the beaten path and avoid the crowds.
